Agreements, decisions or concerted practices that violate European competition law are generally prohibited unless the same conditions are met that would have previously led to an individual exemption. An important disadvantage of the existing system is that companies cannot rely on the position taken by the European Commission or the national authorities with regard to legality until a corresponding individual decision has been made.
