VDMA 24186 contains a service program for the maintenance of technical systems and equipment in buildings.
Maintenance serves to maintain the target condition and availability. It is the basis for safe, hygienic and efficient plant operation. All of this is an essential part of European and national legislation.
VDMA 24186 is aimed in particular at maintenance engineers, operators, manufacturers and planners of technical systems and equipment in buildings. In many cases, it is also an integral part of industry software for building management. In VDMA 24186, users will find a tool designed for practical use, which serves to structure maintenance work, define the scope of services and document the execution of maintenance.
The following trades are included:
- Ventilation and air conditioning technology
- Heating technology
- Refrigeration and heat pump technology
- I&C technology and building automation
- Electrical engineering
- Sanitary engineering
- Fire protection technology
The VDMA offers the service catalogs in digital and editable form to all those who work with building technology systems via a license agreement.
The following license agreements are available for different target groups:
- License agreement for end users (service companies, building operators, etc.)
- License agreement for providers of software solutions (software companies)
The prerequisite for the granting of a license for both contract variants is the one-off payment of the license fee of EUR 349.05 plus VAT.
In addition, there is an annual license fee depending on the contract type:
- License agreement for end users for up to 20 users: EUR 349.05 plus VAT.
- License agreement for end users unlimited users: EUR 698.10 plus VAT
- License agreement for software solution providers: 1,745.25 EUR plus VAT.
After purchase, you will receive a ZIP file with the contents of the service catalogs as Word and PDF, the services as Excel and the logo for use within the limits of the license agreement:
The licensee is entitled to make changes and additions. If a partial takeover takes place and/or changes and additions are made, the licensee is obliged to draw attention to this circumstance within the framework of the existing obligation to provide information in accordance with § 4. The notice must clearly and unambiguously state that the scope and content of VDMA 24186 has been modified.
Obligation to notify
The licensee undertakes to refer to the author's copyrights to the subject matter of the license in a suitable, prominent and clearly visible place in standard font size by adding the following:
"The standard sheet VDMA 24186 is protected by copyright. All rights are owned by VDMA Verband Deutscher Maschinen- und Anlagenbau e.V., Lyoner Straße 18, 60528 Frankfurt/Main. Responsibility for the content lies with the Building Services Maintenance working group in the VDMA's General Ventilation Technology Association. The contact person is Dipl.-Ing. (FH) Thomas Damm (e-mail: thomas.damm@vdma.org)."
In addition, the VDMA logo must be affixed in the immediate vicinity of the above addition. The logo to be used is provided by the VDMA. Any further use of the logo is expressly prohibited.
If the licensee adopts VDMA 24186 with changes in scope and content, he must indicate this in the above manner using the following text:
"The service catalogs for maintenance on technical systems and equipment contained in the software are based on VDMA 24186. In the adoption, modifications have been made to the original edition of VDMA 24186 with regard to scope and content. Users of the software and the documents generated with it are expressly advised of this fact."
Liability
The author has created the licensed items to the best of his knowledge and belief. Defective deliveries for which the Licensor is responsible shall be replaced free of charge. If no replacement is provided, the licensee shall have the right to reduce the license fee or terminate the contract.
Any further liability, in particular for damage that has not occurred to the licensed item itself, is excluded. This does not apply if the damage is due to an intentional or grossly negligent breach of contract by the licensor.
In the event of culpable breach of material contractual obligations, the Licensor shall also be liable for slight negligence, in the latter case limited to reasonably foreseeable damage typical of the contract. Further claims are excluded.
The licensee is solely responsible for the technical implementation and the economic usability of the subject matter of the license.
Termination
The contract is concluded for an indefinite period and can be terminated by the parties at the end of the year with a notice period of 6 months. In addition, the licensee has a special right of termination in the following cases:
- Increase in the annual license fee
- Withdrawal without replacement of an existing part within the VDMA 24186 series (§ 2c)
This special right of termination must be exercised within 4 weeks of
- receipt of the invoice for the annual license fee, or
- after receipt of the notification of the withdrawal of a part without replacement
be exercised in writing. The right to extraordinary termination without notice for good cause remains unaffected. The licensee may terminate the agreement without notice if the licensor was not permitted to dispose of the right to the licensed item. The Licensor shall be entitled to such a right of termination in particular if:
- the licensee fails to pay the license fee due despite a reminder,
- the licensee makes changes to the content or design of the subject matter of the license in violation of Section 3 (2), or
- the licensee culpably violates other essential contractual obligations towards the licensor.
