As part of a plant construction or machine supply contract, the functionality of all delivered systems and components must be determined before handover to the customer (client). Traditionally, this requires a team on site to carry out this "commissioning" or "startup". The coronavirus situation has presented companies with major challenges and required them to adapt their processes - important projects have come to a standstill shortly before completion. In many places, for example, travel restrictions meant that on-site commissioning by the contractor/supplier could not take place. The reason for the introduction of remote commissioning may often have initially been health and safety-related. However, it was also very quickly established that work processes, customer service and effort could be improved and costs reduced at the same time. Remote support will therefore play an increasingly important role in commissioning in the future. At the same time, there is great uncertainty as to what legal requirements this process change will trigger. Do liability aspects need to be reassessed? What will change in terms of contract design? Are there any additional government regulations that need to be taken into account?
These and similar questions are of particular concern to the supplying manufacturer.
This guide is intended to help you better understand and handle the legal situation surrounding "remote commissioning".
